1. Dilapidations Liabilities

As an occupier of commercial premises it is likely that your lease contains a repairing clause linked to the termination of your lease. Dilapidations liabilities can be considerable and it is important to manage your repairing liability accordingly.

There are two methods for settling dilapidations claims:-

  • Agreement of a financial settlement post expiry of the lease
  • Compliance with repairing liability prior to the expiry of the term

As an occupier, the second option is often the most cost effective. By carrying out the works prior to the end of the lease the landlord cannot include additional costs such as delays to marketing, missed rent and vacant rates liabilities.
